OEB clarifies residence documentation requirements for third-country nationals

The Cyprus Employers & Industrialists Federation (OEB), in consultation with the Director of the Immigration Department of the Deputy Ministry of Migration and International Protection, has issued clarifications regarding the obligation to document the residence of third-country nationals entering or residing in Cyprus for employment purposes.

According to the Law on Aliens and Immigration (CAP.105), Article 18YST, for issuing, modifying, or renewing a single employment permit, the following conditions must be met:

  • (b) The third-country national holds a valid residence permit in Cyprus, applies in person, and has an address in the areas controlled by the Government of the Republic.
  • (e) The third-country national has satisfactory accommodation that meets safety and hygiene standards or is provided with such accommodation by the employer.

To confirm residence, the following are required:

  • Presentation of a title deed or rental document. An original is not required; a copy suffices.
  • If the document is not in the foreigner’s name, a certificate from the person named on the document confirming the foreigner’s residence is necessary.

Upon first entry, third-country nationals can declare a temporary residence address, such as hotels or other temporary accommodations, until a permanent residence is arranged. Once permanent residence is established, the relevant information must be submitted to authorities.

During residence permit renewal, proof of permanent residence (title deed or rental document) must be provided, along with a certificate if applicable. These documents must be available and complete at the time of application submission.

To avoid delays or legal issues regarding foreign workers’ residence, businesses are advised to implement internal procedures to maintain a file of all related documents. Employers should ensure employees provide required documents promptly, especially when accommodation is not provided by the employer.
