Public consultation on fees under the NIS2 legislation

The Federation of Employers and Industrialists (OEB) has announced a public consultation on the regulations concerning fees related to the implementation of the Network and Information Systems Security legislation, aligned with the NIS2 Directive.

The consultation is available on the e-Consultation online platform and is open for comments until Friday, February 27, 2026. The full text of the consultation and the relevant legislation are accessible through the provided links.

The framework under consultation specifies fees to be paid by organizations classified as core or significant entities, based on legislation and decisions by the competent authority.

Who is it for: Businesses and organizations active in sectors such as energy, transport, hospitals, digital services, telecommunications, cloud, data centers, critical infrastructure, and other critical services.

Changes in practice: In addition to cybersecurity compliance obligations, a financial burden is introduced through fees for supervision and implementation of the framework.

The OEB emphasizes the importance of feedback from its members regarding:

  • The appropriate determination of a minimum administrative fee
  • The decoupling of fees from administrative costs
  • The inability to establish a credible budget for 2026 and beyond
  • The potential need for further specialization and control strengthening for predictability, proportionality, and fair distribution of costs
  • Any other factors affecting these organizations
